Can i claim from the Landlord as still waiting from the insurance company to pay out.

I have a leasehold flat in a freeholder building. there was a leak from an empty upstairs flat which cause damge to my flat.

I put in a claim and an estimate of work to be carried out and sent all necessary paperwork to the insurance company. This was nearly a year ago. The company is not happy with their insurance. Obviously i had to pay for the work to be carried out.

What can I do? Can I claim the money back from the Landlord? If so, what procedure would I necessarily have to take?

Any information welcome.

When you say "you have", do you mean you're a tenant on an AST to a landlord who owns the leasehold flat ?

And when you say "landlord" do you mean landlord of your flat - or owner of the freehold of the block ?

(but basically my understanding is that unless it's negligence of the freeholder to common part (e.g. common drain or water pipe leaking in common part rather than from inside the flat above) - then the only person you can claim against is owner of flat above)
