MPs have passed a bill outlawing the illegal subletting of social housing properties.

At Landlord Referencing we welcome this new bill, as we fully understand that tenancy cheats can potentially earn thousands of pounds a year by renting out their social homes, whilst hundreds of thousands of deserving families are left languishing on social housing waiting lists.

But where does this leave private landlords and tenants?

We talk to 100′s of landlords and letting agents on a daily basis and subletting is becoming an ever increasing problem that is also plaguing the private rented sector.

Serial Sub-letting Saga.

But because subletting private property is a breach of contract, rather than a criminal offence, the private landlord has no choice but to go through the lengthy process of obtaining a court order eviction in order to remove the original tenant from the property and once this is gained; an eviction order can then remove whoever is inhabiting the property.
In the mean time, the tenant (who cannot be evicted without a court order) can simply continue to take money from the subletting tenants and not pass it onto the landlord.

With the Private Rented Sector expected to house more people than any other sector in the not so distant future Landlord Referencing Services call on the government to include the PRS in any legislation that is designed to prevent undeserving tenants holding tenancies that could be used for those who are deserving.

definitely. it might reduce some of the antisocial behaviour in some neighbourhoods. when i evicted a tenants i found four sets of keys for the house.  i had already tackled him on the number of people hanging around the house patio annoying neighbours.  i had suspicions, but it is a breach of contract in the private sector.  If a housing benefit person takes money for subletting a property they have to notify the council as this is income!
